For live event work and commissioned art work:

a. The Artist will not assume what is required. Page orientation, layout of the image, size, etc, will have to be discussed and agreed.

b. The Client must specify the content of their scene to the best of their ability prior to the Artist/Client Agreement using the booking form and/or communicating with the Artist.

c. There is a 25% non-refundable deposit to the paid to secure the date for live event work. The remaining balance (and postage and packaging if 50 miles from Gosport [not including Isle of Wight]) must be paid by 1 week before the event date. The Artist reserves the right to refuse service and retain the non-refundable deposit if the remaining payment is not made on the agreed date. Payments can be made in instalments and the Artist will provide an invoice for each payment.

d. The Artist reserves the right to stop work, or cancel an event request, due to poor communication, rude/inappropriate behaviour, or a breach of these terms and conditions and/or the agreement.

e. The Artist will not create and depiction of sexually explicit (i.e. "X-rated", pornographic, simulated sex, or sexual arousal) materials, fetishes, or any form of hateful or racist imagery. The Artist reserves the right to refuse these artwork requests.

f. The time taken to complete an artwork in studio can be up to 3 working weeks from the event date. For commissions, there is also up to 3 working weeks for a piece to be completed.

g. Due to the Artist's artistic approach and the physical properties of the media used, the outcome of an artwork piece is likely to move away from a "photorealistic" copy of a photograph. Texture, light, and tone may be manipulated at the Artist's discretion in order to present a subject which focuses on personality and character.

h. When requesting artwork for an event, the client is paying for the time, travel, materials, and expertise to create the work. For commissions, it is the same save for the travel.

i. The Artist takes photos of guests in order to have a reference and to complete the artwork. It is permanently deleted once a drawing is completed. This is the same for commissioned art work.

j. The Artist is to be provided a meal for live event work. If no meal is provided the artist reserves the right to go off-site for a meal for 60 minutes at an appropriate time for the Artist.

k. If not being collected or delivered by the Artist, artwork is posted Special delivery, Next Day. The Artist documents the condition of the artwork when it is packaged. An email notification will be sent containing tracking details for the parcel. If the artwork is being delivered in person, an appropriate date and time will be agreed between the customer and artist during the time of approval for the artwork. This postage and package fee is not inclusive of the price.

l. In the unfortunate circumstance a parcel arrives damaged and has affected the artwork inside, a replacement (the Artist takes photos of the work throughout the event and will keep them with the Client's file) or refund (the deposit remains non-refundable as is the postage and packaging) is applicable. If a parcel appears to be damaged upon delivery, the delivery driver must be made aware upon receipt and the Client must sign for as ‘damaged in transit’ in the signature box. Photographs of the parcel and artwork must be taken and emailed to the Artist within 24 hours of receipt: jpwornham@yahoo.com

If the Client would like a replacement or refund regarding an artwork ‘damaged in transit’, the artwork must be returned within 30 days of the order being sent. The cost of return postage is at the Client's expense. No amount can be refunded or a replacement can be issued until the item has been returned. Please note, the artwork is the Client's responsibility until the artwork is received by the Artist. It is advised to ensure the artwork is securely wrapped and to retain proof of postage when returning the artwork via post.

m. No other exceptions for refunds as the artwork has been intentionally requested by the Client and cannot be resold due to the bespoke and personalised element of the artwork.

n. The Client may display the artwork in profiles as long as the Artist's name ("J P Wornham") is prominently displayed. All rights are reserved on artwork created by J P Wornham. The Artist has the right to publish and share images of any artwork that has been produced. No artworks are to be reproduced, recreated or sold in any way. Unless opted out in the Artist/Client Agreement, the Artist may use the copy of artwork for marketing purposes in the portfolio, website, and social media.

o. All original artwork should be kept out of direct sunlight. With proper care, any artwork will last for generations to come. However, as the Artist has no control over the environmental destination of the artworks the Artist cannot accept responsibility for deterioration or damage after delivery.

p. Prices and postage costs are subject to change due to charging appropriately for the artist’s time and dedication to each artwork. Prices may also change due to material costs, additional time spent on artwork, etc. Prices are reviewed annually and subject to change on the following date: 5 April. When a Client is quoted for a price, it will be honoured and remain valid for 1 month from the date the quote was provided by the Artist. This is to allow a friendly buffer period if a quote is given shortly before 5 April.

**Workshop Refund Policy:**

1. **Refunds for Client Cancellations:**

- Clients may cancel their workshop booking subject to the following conditions:

- Full refund less a £5 admin fee if cancellation is made 7 days before the scheduled class.

- 50% refund if cancellation is made up to 24 hours before the scheduled class.

- No refund will be issued for cancellations made less than 24 hours before the scheduled class.

2. **Refunds for Class Cancellations:**

- A full refund will be granted if the workshop is cancelled by the tutor or venue for any reason.

3. **Cancellation Process:**

- To cancel your workshop booking, please notify us via email at jpwornham@yahoo.com.

- Refunds will be issued through the original payment method used for the booking.

4. **Exceptions:**

- Refunds will not be granted for no-shows or partial attendance.

- If a client fails to attend the workshop without prior notice, no refund will be issued.
